Terms and Conditions for Branwynn Destinations

Welcome to Branwynn Destinations. By booking, purchasing, or participating in any retreat, event, or service provided by Branwynn Destinations (hereinafter referred to as “Company,” “we,” “us,” or “our”), you agree to comply with and be legally bound by the following Terms and Conditions. If you do not agree to these terms, please refrain from using our services.

1. Definitions

  • Participant refers to any individual who books or participates in a retreat or event hosted by the Company.
  • Retreat refers to any travel experience, workshop, event, or program organized by the Company.
  • Force Majeure includes but is not limited to acts of God, war, government restrictions, pandemics, civil commotions, marshall law, government coos, political strife,strikes, severe weather conditions, i.e. hurricanes, tornadoes, floods, fires, mudslides, volcanic activity, severe storms, hail,and other events beyond the Company’s reasonable control.

2. Eligibility

Participants must be at least 18 years of age or provide written consent from a legal guardian if under 18. It is the Participant’s responsibility to ensure they meet the requirements for participation in any retreat.

VIOLATIONS BY YOU. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) you being denied access to the applicable travel related product or service.

3. Contract Upon making a booking with Branwynn Destinations, you have agreed that you have read and understand these Terms & Conditions, that you as Participant agree and accept these conditions.

 

4. Booking and Payment

  • Deposits: A non-refundable deposit is required to secure your spot in a retreat. The amount of the deposit will be specified on the event page, typically $500.
  • Final Payments: The balance must be paid in full by the specified deadline. 180 days prior to departure date and failure to do so may result in forfeiture of your booking. Any booking made within 90 days for departure date must be paid in full.
  • Payment Methods: We accept payment via Visa, Mastercard, AmEx, Debit and bank transfers and Zelle transfers.
  • Currency: All prices are listed in USD, unless otherwise stated.

5. Cancellation Policy

  • By Participant:
    • Cancellations made more than 60 days before the retreat start date will receive a 20% refund of any payments made minus the non-refundable deposit.
    • Cancellations made less than 60 days before the retreat start date are non-refundable.
    • No-shows or early departures will not be refunded.
  • By the Company:
    • We reserve the right to cancel any retreat for reasons including but not limited to Force Majeure, insufficient participation, or unforeseen circumstances.
    • In such cases, Participants will receive a full refund of all payments made, excluding any expenses incurred by the Participant (e.g., airfare).

6. Travel Insurance

We expect that Participants will obtain comprehensive travel insurance that covers trip cancellation, medical emergencies, personal liability, and any other relevant scenarios. The Company is not responsible for any expenses or losses incurred as a result of not obtaining insurance. Information listed under ”Resources” on the bottom of the website.

7. Health and Safety

  • Participants are responsible for ensuring their physical and mental fitness to participate in the retreat activities.
  • Participants must disclose any pre-existing medical conditions, allergies, or dietary restrictions to the Company in advance.
  • The Company reserves the right to decline participation to anyone deemed unfit for the retreat.
  • The Company is not liable for injuries, illnesses, or accidents that occur during the retreat. Participants must adhere to all safety guidelines provided by the Company or its representatives.

8. Assumption of Risk

By participating in a retreat, you acknowledge that travel and physical activities involve inherent risks. You assume all risks associated with such activities, including but not limited to personal injury, property damage, illness, or death. You further agree to release, waive, discharge, and hold harmless the Company, its employees, contractors, and affiliates from any and all claims, damages, or liabilities arising out of or in connection with your participation in the retreat. Branwynn Destinations is not responsible for any injury, sickness and costs incurred as a result.

Branwynn Destinations is not responsible for any issue, concerns, fees or changes with purchase of airfare, completed independently by Participant, and governed by the terms and conditions of the carrier.

The Participant is solely responsible for filling out all registration information completely and accurately and for double checking the information is correct and matches official travel documents. Branwynn Destinations is not responsible for any discrepancy that may cause delay, fees or logistical difficulties. 

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its employees, contractors, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or in connection with:

  • Your participation in the retreat.
  • Your breach of these Terms and Conditions.
  • Your violation of any law or the rights of a third party.
  • Any personal injury, property damage, or loss caused by your negligence or willful misconduct.

Branwynn Destinations is an independent contractor and in no way responsible for any third party vendors, including but not limited to any flights, transportation, hotel, venues, restaurants, excursion companies or any outside arrangements made seperatley by Participants during “open” or “free” days. Participants who make these arrangements do so under the terms and conditions of the particular venue hired.

10. Code of Conduct

Participants are expected to behave respectfully and responsibly during the retreat. The Company reserves the right to remove any Participant who engages in:

  • Harassment, discrimination, or inappropriate behavior toward others, whether other participants, vendors or third party operators. 
  • Disrespectful, obnoxious, or harassing behavior will not be tolerated and persons engaging in this may result in the Participant being left at any location and Branwynn Destinations is not required to refund any portion or amount of retreat, nor responsible for any costs incurred should this occur.
  • Actions that endanger the safety of others or disrupt the retreat. No refunds will be issued in such cases.

11. Force Majeure

The Company is not liable for failure to perform or deliver services due to Force Majeure events. In such cases, the Company will make reasonable efforts to reschedule or adjust the retreat but will not be responsible for refund..

 Branwynn Destinations assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, surnami, environmental effect of contamination or pollution, inclement weather, earthquake, low or high water levels, flood, water or power failures or shortages, severe storms, flooding or riots or civil disturbances or unrest, and any other acts of a similar nature, sabotage, protests/arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, health advisories, epidemics, pandemics, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Branwynn Destinations that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions.In the circumstances amounting to force majeure, we will not be required to refund any money.

 

12. Liability Waiver

By booking or participating in a retreat, you release the Company, its employees, contractors, and partners from any liability for personal injury, property damage, loss, or theft occurring during the retreat. This waiver extends to all activities, including transportation, accommodations, and excursions organized by the Company.

The Company is not responsible for the actions, omissions, or services provided by third-party vendors such as hotels, transportation providers, excursion operators, or sightseeing companies. Participants acknowledge that these third parties operate independently of the Company and assume all risks associated with their services.

The Company is also not responsible for any delays, issues, or additional costs related to flights or baggage, including but not limited to missed connections, cancellations, or lost or damaged luggage. Participants are advised to contact their airline directly to resolve such matters.

13. Intellectual Property

All content provided by the Company, including but not limited to photographs, videos, course materials, and branding, is the intellectual property of the Company. Participants may not reproduce, distribute, or use such content without prior written permission.

14. Privacy Policy

The Company respects your privacy and is committed to protecting your personal information. By using our services, you consent to the collection and use of your information in accordance with our Privacy Policy. We will never share your information with third parties without your consent, except as required by law and used for express purposes of any logistical arrangements for the retreat Participant is attending. 

15. Dispute Resolution

  • Any disputes arising out of or relating to these Terms and Conditions will be resolved through mediation. If mediation fails, disputes will be subject to binding arbitration in accordance with the laws of [Insert Jurisdiction].
  • Participants waive the right to bring class-action lawsuits against the Company.
  • Participants also agree that Branwynn will not consider any claim without first having the opportunity to assist you during your trip, and there must be written submission within 30 days upon completion of trip and that a maximum of 50% of commission earned for your specific trip.



16. Amendments to Terms and Conditions

The Company reserves the right to update or modify these Terms and Conditions at any time. Participants will be notified of any significant changes. Continued use of our services constitutes acceptance of the updated terms.

17. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any legal actions or proceedings arising out of these terms must be brought exclusively in the courts of [Insert Jurisdiction].
