Terms and Conditions and Travel Insurance Waiver for Branwynn Destinations, LLC

Welcome to Branwynn Destinations. By booking, purchasing, or participating in any retreat, event, or service provided by Branwynn Destinations (hereinafter referred to as “Company,” “we,” “us,” or “our”), you agree to comply with and be legally bound by the following Terms and Conditions. If you do not agree to these terms, please refrain from using our services.

 

1. Definitions

  • Participant refers to any individual who books or participates in a retreat or event hosted by the Company.
  • Retreat refers to any travel experience, workshop, event, or program organized by the Company.
  • Force Majeure includes but is not limited to acts of God, war, government restrictions, pandemics, civil commotions, martial law, government coups,(“labor disputes,” “cyber- attacks,” and “government-mandated health closures” to cover modern travel disruptions), political strife,strikes, severe weather conditions, i.e. hurricanes, tornadoes, floods, fires, mudslides, volcanic activity, severe storms, hail,and other events beyond the Company’s reasonable control.

2. Eligibility

Participants must be at least 18 years of age or provide written consent from a legal guardian if under 18. It is the Participant’s responsibility to ensure they meet the requirements for participation in any retreat.

VIOLATIONS BY YOU. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) you being denied access to the applicable travel related product or service

3. Contract 

Upon making a booking with Branwynn Destinations, you have agreed that you have read and understand these Terms & Conditions, that you as Participant agree and accept these conditions.

4. Booking and Payment
  • Deposits: A non-refundable deposit is required to secure your spot in a retreat. The amount of the deposit will be specified on the event page, typically $500
  • Final Payments: The balance must be paid in full by the specified deadline. 180 days prior to departure date and failure to do so may result in forfeiture of your booking. Any booking made within 90 days for departure date must be paid in full.
  • Payment Methods: We accept payment via Visa, Mastercard, AmEx, Debit and bank transfers and Zelle transfers.
  • Currency: All prices are listed in USD, unless otherwise stated.

5. Cancellation Policy

  • By Participant:
    • Cancellations made within 48 hours are fully refunded.
    • Cancellations made less than 120 days before the retreat start date are non-refundable.
    • No-shows or early departures will not be refunded.
    • Cancellations between 120 and 180 days will receive half of money paid, not including the non refundable deposit.
    • Cancellations made more than 180 days will be refunded, minus the non-refundable deposit.
  • By the Company:
    • In such cases, Participants will receive a full refund of all payments made, excluding any expenses incurred by the Participant (e.g., airfare). We reserve the right to cancel any retreat for reasons including but not limited to Force Majeure, insufficient participation, or unforeseen circumstances.
    • In such cases, Participants will receive a full refund of all payments made, excluding any expenses incurred by the Participant (e.g., airfare).

6. Travel Insurance

We expect that Participants will obtain comprehensive travel insurance that covers trip cancellation, medical emergencies, personal liability, and any other relevant scenarios. The Company is not responsible for any expenses or losses incurred as a result of not obtaining insurance.

Information listed under ”Resources” on the bottom of the website. We cannot stress enough the importance of protecting your investment. Travel insurance is highly recommended for all participants,If a participant chooses to travel without insurance, they must sign a separate waiver acknowledging that branwen destinations will not be liable for any parentheses including medical evacuation or trip interruption parentheses that insurance would have otherwise covered.

7. Health and Safety

  • Participants are responsible for ensuring their physical and mental fitness to participate in the retreat activities.
  • Participants must disclose any pre-existing medical conditions, allergies, or dietary restrictions to the Company in advance.
  • The Company reserves the right to decline participation to anyone deemed unfit for the retreat
  • The Company is not liable for injuries, illnesses, or accidents that occur during the retreat. Participants must adhere to all safety guidelines provided by the Company or its representatives.
  • Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Branwynn Destinations cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred.If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.
  • Participants are solely responsible for complying with all health entry requirements for the destination, including but not limited to vaccinations, Covid 19 testing, and health affidavits. Failure to meet these requirements does not constitute grounds for a refund.

8. Assumption of Risk

By participating in a retreat, you acknowledge that travel and physical activities involve inherent risks. Participants agree to disclose medical conditions that might affect their safety or the group’s experience, providing the Company the right to disqualify a participant (without refund) if they pose a safety risk. You assume all risks associated with such activities, including but not limited to personal injury, property damage, illness, or death. You further agree to release, waive, discharge, and hold harmless the Company, its employees, contractors, and affiliates from any and all claims, damages, or liabilities arising out of or in connection with your participation in the retreat. Branwynn Destinations is not responsible for any injury, sickness and costs incurred as a result. Branwynn Destinations is not responsible for any issue, concerns, fees or changes with purchase of airfare, completed independently by Participant, and governed by the terms and conditions of the carrier.

The Participant is solely responsible for filling out all registration information completely and accurately and for double checking the information is correct and matches official travel documents. Branwynn Destinations is not responsible for any discrepancy that may causen delay, fees or logistical difficulties.


9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its employees, contractors, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or in connection with. 

  • Your participation in the retreat.
  • Your breach of these Terms and Conditions.
  • Your violation of any law or the rights of a third party.
  • Any personal injury, property damage, or loss caused by your negligence or willful misconduct.

Branwynn Destinations is an independent contractor and in no way responsible for any third party vendors, including but not limited to any flights, transportation, hotel, venues, restaurants, excursion companies or any outside arrangements made separately by Participants during “open” or “free” days. Participants who make these arrangements do so under the terms and conditions of the particular venue hired.


10. Code of Conduct

Participants are expected to behave respectfully and responsibly during the retreat. The Company reserves the right to remove any Participant who engages in:

  • Harassment, discrimination, or inappropriate behavior toward others, whether other participants, vendors or third party operators.
  • Disrespectful, obnoxious, or harassing behavior will not be tolerated and persons engaging in this may result in the Participant being left at any location and Branwynn Destinations is not required to refund any portion or amount of retreat, nor responsible for any costs incurred should this occur.

Actions that endanger the safety of others or disrupt the retreat. No refunds will be issued in such cases.

11. Force Majeure

    The Company is not liable for failure to perform or deliver services due to Force Majeure events. In such cases, the Company will make reasonable efforts to reschedule or adjust the retreat but will not be responsible for refund..

    Branwynn Destinations assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, surnami, environmental effect of contamination or pollution, inclement weather, earthquake, low or high water levels, flood, water or power failures or shortages, severe storms, flooding or riots or civil disturbances or unrest, and any other acts of a similar nature, sabotage, protests/arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, health advisories, epidemics, pandemics, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Branwynn Destinations that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions.In the

    circumstances amounting to force majeure, we will not be required to refund any money.

    12. Liability Waiver

    Any Changes:: If between planning time and/or during actual travel, circumstances require changes, Branwynn Destinations and its suppliers, reserve the right to cancel or vary any itinerary and substitute components of any trip, including but not limited to hotels and accommodations of comparable quality, if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on the trip. Tours, safaris and other activities may be altered as described above. Branwynn Destinations cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes and will not be considered cause for cancellation by the traveler. Normal cancellation penalties still apply to the trip that has been changed.


    13. Third-Party Suppliers

    By booking or participating in a retreat, you release the Company, its employees, contractors, and partners from any liability for personal injury, property damage, loss, or theft occurring during the retreat. This waiver extends to all activities, including transportation, accommodations, and excursions organized by the Company.

    The Company is not responsible for the actions, omissions, or services provided by third-party vendors such as hotels, transportation providers, excursion operators, or sightseeing companies. Participants acknowledge that these third parties operate independently of the Company and assume all risks associated with their services.

    The Company is also not responsible for any delays, issues, or additional costs related to flights or baggage, including but not limited to missed connections, cancellations, or lost or damaged luggage. Participants are advised to contact their airline directly to resolve such matters. “Branwynn Destinations shall not be liable for any losses, damages, or expenses resulting from the financial insolvency, bankruptcy, or cessation of operations of any third-party supplier (e.g., airlines, hotels, tour operators).”


    14. Intellectual Property

    All content provided by the Company, including but not limited to photographs, videos, course materials, and branding, is the intellectual property of the Company. Participants may not reproduce, distribute, or use such content without prior written permission. Media Release: By participating you grant branwen destinations a royalty free, perpetual license to use your likeness in photographs or videos taken during the retreat for promotional and marketing

    purposes, unless you provide written notice otherwise before the trip begins.

    15. Privacy Policy

    The Company respects your privacy and is committed to protecting your personal information. By using our services, you consent to the collection and use of your information in accordance with our Privacy Policy. We will never share your information with third parties without your consent, except as required by law and used for express purposes of any logistical arrangements for the retreat Participant is attending.

      16. Dispute Resolution


      • Any disputes arising out of or relating to these Terms and Conditions will be resolved through mediation. If mediation fails, disputes will be subject to binding arbitration in accordance with the laws of Florida.
      • Participants waive the right to bring class-action lawsuits against the Company. Participants also agree that Branwynn will not consider any claim without first having the opportunity to assist you during your trip, and there must be written submission within 30 days upon completion of trip.
      • In no event shall the Company’s total aggregate liability to any participant for any and all claims arising out of this agreement exceed 50% of the Commission earned by the Company for that specific participants trip

        17. Amendments to Terms and Conditions

        The Company reserves the right to update or modify these Terms and Conditions at any time. Participants will be notified of any significant changes. Continued use of our services constitutes acceptance of the updated terms.

        18. Governing Law

        These Terms and Conditions are governed by and construed in accordance with the laws of Florida. Any legal actions or proceedings arising out of these terms must be brought exclusively in the courts of Florida.

        TRAVEL INSURANCE WAIVER & RELEASE OF LIABILITY

        1. Recommendation of Insurance Branwynn Destinations (the “Company”) strongly recommends that all Participants purchase a comprehensive travel insurance policy. A suitable plan should include coverage for trip cancellation, trip interruption, emergency medical expenses, emergency medical evacuation/repatriation, and lost or damaged baggage.
        2. Acknowledgment of Risk I, the undersigned Participant, acknowledge that I have been informed of the importance of travel insurance. I understand that international travel and retreat activities involve inherent risks, including but not limited to illness, injury, political unrest, and Force Majeure events. I am aware that without insurance, I am personally responsible for any costs incurred due to these unforeseen circumstances.
        3. Election to Decline Coverage By signing this waiver, I explicitly elect to decline purchasing a travel protection plan for this Retreat. I certify that I have either:

        • Confirmed that my existing personal insurance policies provide adequate international coverage for the specific risks associated with this trip; OR
        • Chosen to assume all financial risks associated with traveling without insurance


        4. Assumption of Financial Responsibility I agree to be solely responsible for all costs, expenses, and losses that may arise during or in connection with the Retreat which would have otherwise been covered by a travel insurance policy. This includes, but is not limited to:


        • Non-refundable trip costs in the event of my cancellation or early departure.
        •  Medical expenses, hospital bills, and medications.
        • Costs for emergency medical evacuation or repatriation of remains.
        • Additional lodging or transportation costs due to travel delays or itinerary changes.
        5. Release and Indemnification In consideration of being permitted to participate in the Retreat, I hereby release, waive, and forever discharge Branwynn Destinations, its owners, employees, and contractors from any and all liability for financial loss, personal injury, or property damage that results from my decision to travel without insurance. I further agree to indemnify and hold the Company harmless from any claims or expenses (including legal fees)
        arising from my lack of coverage.

        6. Governing Law This waiver shall be governed by the laws of the State of Florida, and any disputes shall be resolved in accordance with the Dispute Resolution terms outlined in the Company’s general Terms and Conditions.

        HAVE READ THIS WAIVER IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT.
